Broad-ranging  commercial insurance practice primarily representing public companies (TSX, NYSE, NASDAQ), private companies or their boards in connection with director and officer indemnification and insurance issues in  regulatory and criminal investigations, shareholder and securities litigation and other class actions and regulatory and criminal proceedings.   Leading Canadian policyholder practice performing independent insurance program reviews for corporate policyholders regarding the comprehensiveness and appropriateness of their directors and officers liability insurance coverage and suggested enhancements. Frequently retained by boards of directors of public companies and financial institutions to perform independent insurance reviews and advise on and negotiate indemnification and coverage for securities and other statutory and common law exposures.


Insurance dispute resolution practice includes coverage opinions, neutral evaluations, litigation, mediation and arbitration of matters involving directors and officers liability, fiduciary liability, all risk property, boiler and machinery, marine, crime, commercial general liability, Builders Risk, environmental and professional errors and omissions policies and financial institution bonds.  Has acted as Canadian coverage counsel in connection with cross-border securities class actions. 


Extensive experience in the organization and conduct of forensic and fraud investigations in conjunction with leading forensic accountants; preparation of financial institution bond claims and other insurance claims; preparation of investigative reports and advising special committees, senior officers, directors, liquidators and trustees regarding director, officer and employee malfeasance and actions for recovery of assets and insurance proceeds; conduct of subsequent litigation and liaising with law enforcement officials and regulators in respect of criminal and quasi-criminal prosecutions arising out of forensic investigations.  Acted as counsel to the Canadian Institute of Chartered Accountants (CICA) Alliance for Excellence in Investigative and Forensic Accounting in connection with the development of their Standards for Investigative and Forensic Accounting Engagements.
